Frequently Asked Questions & DoPT Guidelines
Under Department of Personnel and Training (DoPT) guidelines, the Crucial Date for determining eligibility criteria (including age, educational qualification, and reservation category status) is strictly the closing date for receipt of online applications specified in the recruitment notification, unless an explicit cutoff date is separately mentioned. Candidates must satisfy the category status on or before this date.
As per DoPT Office Memorandum No. 36033/1/2013-Estt.(Res) dated 27th May 2013 and OM No. 36036/2/2013-Estt.(Res-I) dated 31st March 2016, an OBC-NCL certificate issued within 3 consecutive financial years prior to the crucial date of application is accepted for appointment. This rule recognizes that determining creamy layer status is based on income over three consecutive financial years. Certificates older than 3 years are deemed expired and ineligible.
Under DoPT OM No. 36039/1/2019-Estt(Res), an EWS Income & Asset certificate has two distinct financial year entries:
- Validity Financial Year: The financial year during which the candidate applies for the post (e.g. FY 2025–26).
- Income Financial Year: The immediately preceding financial year on which family income was assessed (e.g. FY 2024–25).
Recruiting bodies like SSC and UPSC usually mark candidates as Provisional (P) or shift them to the UR (Unreserved) category if their marks satisfy the UR cutoff. While the Hon’ble Supreme Court in Ram Kumar Gijroya v. Delhi Subordinate Services Selection Board (DSSSB) (2016) ruled that reservation is a constitutional status and cannot be denied merely due to late production of a certificate, commissions often mandate an affidavit or an earlier certificate issued before the cutoff date during Document Verification.
As per DoPT OM No. 36012/22/93-Estt.(SCT) and clarified in OM No. 36033/1/2013-Estt.(Res), income from salary and agricultural land is excluded from the calculation of the gross annual income ceiling (₹8,00,000 per annum). Only income from other sources (such as business, profession, consultancy, or other non-salary sources) for three consecutive financial years is taken into account to determine the Non-Creamy Layer status.
