The upper house is called the Bihar Legislative Council. The Bihar Vidhan Sabha consists of 243 members who are elected by the people of Bihar through a democratic voting process. The term of the members of the Bihar Vidhan Sabha is five years, unless dissolved earlier.

It also has the power to hold the state government accountable for its actions through various means such as question hour, calling attention motion, and no-confidence motion. The chief minister and the council of ministers are appointed by the governor of Bihar, who is the head of the state.
